Facts You Need to Know About Worker’s Compensation Back Injuries

With residential and commercial renovations reaching some of the highest points within the last few decades, across the state of New Jersey, one of the most common professions amongst young male is working in the field of construction. Now this can both include working under a contractor as a young construction worker learning the ropes, or as an experienced contractor leading a crew of your own for all types of renovations – both residential and commercial. And while this field has become far more popular due to having far fewer barriers to entry, while also providing young men in their late teens and twenties a fairly lucrative salary – one of the most common issues is how prevalent injuries are on a construction site. And amongst construction site injuries, back injuries have become the most prevalent on the work site – leading to an ever-increasing number of worker’s compensation claims. According to recent studies and the team at Comprehensive Spine Care, the top orthopedic practice for back injury workers comp NJ has to offer, such injuries can go from being the most minute and simple, to being fairly severe issues that may end up involving nerve damage as well as certain spine issues. According to Dr. Evan Baird, when it comes to a back injury workers comp NJ, its no surprise that the state is also one of the leaders in that category as well. The fact is that while construction work can be lucrative for someone willing to work overtime, sacrifice, certain time off that others might want, and more – paying for back surgery or even far less invasive forms of treatment can be quite expensive and nearly impossible to afford on such a salary. Luckily for those involved in construction site injuries, workers who filed claims for a back injury were very likely to receive at least some compensation through workers’ comp. According to our survey, 74% of workers with back injuries received compensation, either through a voluntary settlement or through an award by a judge after a workers’ compensation hearing. Only 26% of workers with back injuries did not receive a settlement or award – and these cases are few and far between.

And in identifying such an issue, the team at Comprehensive Spine Care, the top orthopedic practice for back injury workers comp NJ has around, settlements are relatively fair and will generally always cover the patient’s full treatment needs. However, things like additional physical therapy and post-surgical care (if needed) are generally sticking points – as with pretty much any medical negotiation, especially when it has to do with insurance or workers comp payments. While it might still be difficult, when a patient has a back issue, insurance and workers comp, will generally look favorably on such injuries as they may end up involving the delicate spinal area. On average, those individuals with workers compensation claims of all types were awarded approximately $21,800. However, for those who suffered from a back injury covered under workmans comp insurance NJ on average, would provide them with about $23,600 – approximately a full $2000 more than other injured workers.

The important thing to understand with workmans comp insurance NJ lawmakers are cognizant of the fact that, first of all, working on a construction site is extremely dangerous and the level of back injury that’s possible there, versus a possible hand injury working at the mall or at an office do not equate at all. Also, secondly, back injuries overall, tend to range far higher in severity. From mild strains requiring only physical therapy and rest to herniated discs that require surgery and ongoing care, back injuries are by far some of the most significant types of injuries covered under workmans comp insurance NJ can provide. Because of this, it’s not surprising that the amount each worker receives can vary significantly. According to our survey, the majority of workers received a relatively modest amount in compensation; 68% of workers with back injuries received $20,000 or less. However, the remaining 32% of workers received significantly higher settlements or awards: 6% received between $20,000 and $40,000, 17% received between $40,000 and $60,000, and 9% received more than $60,000.

In addition, to the significant increase in the dollar amount provided under a worker’s compensation claim for a back injury, there is also a fairly significant amount of additional time provided in order to resolve cases. On average, according to Comprehensive Spine Care, the majority of workers compensation claims can be resolved win slightly under 16 months (to be precise, it is 15.7 months). This is in stark contrast to a worker’s compensation claim for a back injury, which is generally allotted approximately 17.9-18.0 months on average. This is due to the fact that back injuries not only take longer to heal and patients need more time to recover, but also due to the fact that their treatment will require much more time as well.
